TERMS &
CONDITIONS
1. Terms.
All bookings and enquires made to Sundown Disco Roadshow will be subject to
these terms and conditions. Herein, ‘The Company’ will mean Sundown Disco
Roadshow and ‘The Customer’ will be the person, persons or company who has
booked and/or will be paying for the services of the company.
2. Payment.
All deposits are non-returnable. The balance of the payment should be made
on or before the day of the function and must be paid in full before the
event begins. In the event that you cancel the disco less than seven days
before the date of the function, you will still be liable to pay in full the
agreed fee. Cheques are acceptable when accompanied by a valid cheque
guarantee card and should be made payable to ‘Stewart Frodsham’. Referred
cheques or cheques completed incorrectly will be subject to a thirty pounds
(£30.00) administration fee. The agreed fee stated on the Confirmation of
Booking form only covers for services during the stated start and finish
times and the setting up of and dismantling of the equipment. If any extra
service is required it is chargeable at twenty pounds (£20.00) per hour with
a minimum of one hour and payable in one hour increments. For example if you
require and extra one and a half hours you would pay for two hours. Extra
service is also subject to availability and should be discussed with the
performing DJ at the time.
3. Security and Safety
of Equipment.
The security and safety of the equipment during the start and finish times
stated on the Confirmation of Booking form is the responsibility of the
customer (excluding breakdown and technical failure). Should any damage
occur to the equipment in way whatsoever, the customer will be liable to pay
for repair or replacement which ever is applicable. No replacements to be
acquired or repairs undertaken by the customer without prior approval of the
company. On events where Karaoke Is Used, people will not be allowed to sing
whilst holding drinks or cigarettes, co-operation from the customer is
required to enforce compliance with this. If this compliance is not
achieved, then the Karaoke will not be operated further and full payment
will still be due.
4. Weather & Outdoor
Stages.
The company accepts no responsibility for delays caused by weather whether
during travelling or unloading and setting up. The DJ will decide if it is
safe to unload the equipment in the weather conditions he or she is faced
with. For obvious reasons it is not safe to allow electrical equipment to
become wet and then use the equipment before sufficient drying time has
elapsed. If the customer has booked a disco to be staged outdoors, it is the
responsibility of the customer to provide adequate protection from the
weather. Should the DJ decide for any reason whatsoever that the conditions
are unsuitable, then he or she will not unload the equipment until such time
that the conditions become suitable. If you do not have adequate protection
from the weather or another area suitable to stage the disco then you will
still be liable to pay the agreed fee stated on the Confirmation of Booking
form. It is the responsibility of the customer to provide an adequate power
supply is within three metres of the stage, whether it is outdoors or
indoors..
5. Loading and Unloading
Difficulties.
It is the responsibility of the customer to advise the company when booking
of any loading difficulties so that these may be priced for accordingly. If
when the DJ arrives at the venue he or she discovers loading difficulties,
then he will advise the customer of additional charges for them. If he or
she does not have the manpower or equipment to cater for the loading
difficulties then he or she will not be able to unload the equipment and the
customer will still be liable to pay the agreed fee. Loading difficulties
include :- Stairways upwards or downwards, long walking distances from the
parking area to stage area, narrow corridors, human obstructions ie. People
crowding doorways, bars, eating areas etc. The normal duration for the
setting up of the equipment is 40 minutes, loading difficulties will add to
this time. If the customer has not informed the company of the difficulties
then the company will not be liable for starting late and will still finish
at the time stated on the Confirmation of Booking. It is the
responsibility of the customer to provide an area suitable to set up the
equipment and provide an adequate power supply within three metres. Should
the DJ deem the area to be unsuitable for any reason whatsoever, he/she
reserves the right not to continue with the performance and the customer
shall still be liable to pay the agreed fee.
6. Content of the Disco.
The company accepts no responsibility for the content of the disco. The
disco will be conducted by a professional DJ with a great deal of experience
of performing discos. Should the DJ been unable to play a certain song or
songs for whatever reasons, the company accepts no responsibility whatsoever
and will not refund any monies on this basis. It is reasonable to assume
that whilst our DJ’s have vast record and CD collections there is no way
humanly possible that they will ever have every single title ever recorded.
Should you require certain titles for special reasons then you should
contact the company in advance with your requests. However whilst every
effort will be made to obtain the titles no guarantee’s can be given and the
company accepts no responsibility for being unable to obtain and play them.
If you own the songs yourself, the DJ will be happy to play then for you,
however the company accepts no responsibility for loss or damage to your
titles in anyway whatsoever.
7. Liability of Sundown
Disco
In the unlikely event that the company is unable to perform the disco AT the
agreed times and dates, whilst every effort will be made to ensure an
alternative performer is arranged, the company will not be held liable to
pay any costs for anything whatsoever. In the unlikely event that the
company cannot perform the disco for whatsoever reason the company will
completely waive the agreed fee and offer a 25% discount for ONE further
booking which will be valid for a period of one year from the date of the
original function date. The company will not be responsible for anything or
anyone who is damaged or injured in any way whatsoever. Sundown Disco
operates a strict no access policy and so no person whatsoever will be
allowed in the performing area at any time from the time of arrival until we
have left the premises of the function.
